2.    Ownership and service provider

DIEZ GUERRERO S.L as the owner of this website and provider of information society services, in accordance with current legislation on Information Society Services and Electronic Commerce (Law 34/2002, of July 11, on Information Society Services and Electronic Commerce), makes the following information available to users general:

DIEZ GUERRERO S.L, has as its commercial activity, the wholesale trade of watches and jewelry.

 

3.    Scope of application

THE PROVIDER is responsible for the website, and makes this document available to users with which it intends to comply with the obligations set forth in Law 34/2002, on Information Society Services and Electronic Commerce (LSSI-CE).

By registering at http://silverdiez.com and by using our website or any other information provided as part of our services, the user accepts and is bound by the conditions of use of THE PROVIDER, which are incorporated by reference into these Conditions of Use.

THE PROVIDER reserves the right to modify any type of information that may appear on the website, without any obligation to notify or inform users of said obligations, it being understood that publication on this website of the provider is sufficient.

The provider offers its customers high-quality products. Given the characteristics of the products sold on this website, there may be slight differences. Therefore, it is inevitable that the product delivered to the User may differ slightly from that shown in the photographs included in the Portal's purchasing process. Under no circumstances will these differences result in the delivery of items made of poorer quality materials than those displayed on the website. For this reason, the user is informed and aware that the size of the photographs contained on the Portal does not correspond to the actual size of the products offered. For this reason, the user is informed and expressly consents to these circumstances and differences, which may not be grounds for termination of the Contract.

4.    General contracting conditions

4.1.     Contract online

The contract between THE PROVIDER and the user for the purchase of their products will be finalized in writing, establishing the purpose, cause, price, termination of the contract, and any of its contractual clauses, in accordance with the regulations cited above.

The products offered by THE PROVIDER are aimed at companies, entrepreneurs, and professionals. Therefore, we inform you that, under current legislation, an entrepreneur is any natural or legal person acting within the framework of their business or professional activity, whether public or private.

THE PROVIDER provides information in a clear and understandable manner. That is why the products it sells offer the maximum guarantee, both from a technical and legal point of view.

The online order service through the portal regulated in these Contractual Conditions allows for the execution of these orders, in order to acquire the products displayed on the website http://silverdiez.com and is subject to the following particularities:

The delivery locations and shipping costs are as follows, without prejudice to the possibility of delivering to other locations, if there are users who request the purchase of goods outside of the locations cited:

·         Mainland Spain: €4.38+VAT

·         Balearic Islands: €12.75+VAT

· Canary Islands: €12.75+VAT

·         Andorra: €12.75+VAT

INFORMATIVE NOTE.- From a purchase of €125 +VAT, shipping will be free.

4.2.    Prices and taxes

Given the different tax regimes of mainland Spain and the Canary Islands, we inform you of the following:

 Due to their special tax regime, the geographical areas corresponding to the Canary Islands are considered non-EU territories. Therefore, purchases made by residents of these territories are exempt from paying VAT. Customs clearance fees and import taxes are not included in the price of the item or shipping costs and must be paid at the destination by the recipient of the merchandise.

• In sales to the Canary Islands, VAT will not be charged. Under no circumstances can we determine the amount of taxes payable by the customer upon receiving their order, as it will depend on the amount of the "I.G.I.C." and "Canary Islands customs." Therefore, customs fees and the amount of said tax are not included in the price.

• All product prices on the website do not include VAT. This tax will be itemized at the end of the purchase process on the final invoice. The user will receive an invoice, with all the items to be charged itemized, along with the delivery of the products. Discounts are not applied to the prices. They will be effective when we place your order and you will be informed of the final discounted amount.

 

4.3.     Order shipments

THE PROVIDER reserves the right to modify, temporarily suspend or cancel, in at any time, of the service.

THE PROVIDER reserves the right to reject any purchases that do not pass the security controls established in its commerce systems.

Regarding shipments, the following circumstances must be taken into account: Payment methods and delivery times:

      I.        The payment methods will be those agreed between the parties, otherwise, a refund will be chosen, or the receipt will be charged to the account, which will be recorded in the same invoice.

    II.        THE PROVIDER guarantees the preparation of the order and its delivery to the carrier in the shortest possible time, provided that the merchandise is in stock, unlessngencies or causes of force majeure.

   III.        Delivery times may be altered due to regional, local or national holidays.

   IV.        THE PROVIDER reserves the right to vary the type of shipment and the company by which the transport is carried out the merchandise, as long as it does not cause obvious harm to the customer. Under no circumstances will shipments be made to post office boxes.

    V.        Deliveries made in mainland Spain will arrive at their destination one to two business days after delivery of the order by THE PROVIDER. For deliveries outside this territory, delivery times may vary.

   VI.        For deliveries during the Christmas period, the transport agency may be delayed due to shipping saturation at this time.

 VII.        Upon receiving the order, please review it in the presence of the carrier and verify that the number of packages received corresponds to the quantity indicated on the "Shipping Note," as well as their condition. If there are any anomalies, you must note them on the delivery note before signing it, and always in the presence of the carrier. Otherwise, THE PROVIDER will not assume any responsibility for the condition of the merchandise if the claim is made after receipt and delivery, once the delivery note has been signed confirming the condition of the goods.

 

4.4.    Contracting and registration procedure

Before contracting, the User will have at their disposal on the portal, the information regarding the procedures that must be followed for the conclusion of the contract for the sale of products. The steps that the user must follow are the following:

To register and place your order on our portal, you must follow these steps:

• Create a new account, registering your details with the option of incorporating them into our database: Contact details, company name, representative (if applicable), address, NIF, email.

• Select the products in which the user is interested.

• Add the selected products to the Shopping Cart, click on "Place Order" and complete the following information:

1.     Delivery Address

2.     Comments.

3.     Choose the Billing address (only if it is different from the Delivery address).

4.     Choose your payment method.

5.     Confirm order.

If for any reason THE PROVIDER does not accept your order, in the event that it does not comply with the wholesale purchase conditions, we will proceed to notify you immediately by means of a e-mail.

The billing information will be that which appears in the customer's registry. THE PROVIDER will not be liable for any errors in the information provided to us when placing your order. The customer must pay special attention when completing the forms, without prejudice to the possibility of correcting said information after completing the purchase.

If the customer enters incorrect information during the purchase process and its correction results in charges, THE PROVIDER reserves the right to charge the Customer's account for said charges or even cancel the requested purchase.

Once delivery has been completed and payment for the merchandise has been made, the Contract will be deemed concluded between THE PROVIDER and its customer.

4.5.     Payment Methods

Payment for orders can be done in two ways:

•  Cash on Delivery

• Checking account debit

Customers who choose cash on delivery as a payment method must take the following requirements into account. In order to make a cash on delivery payment, the following conditions must be met:

•  It is essential that a good or merchandise be delivered. No type of service may be paid for by cash on delivery.

• The buyer and the seller's representative (the carrier) must be present at the time of delivery of the product.

• The customer must pay in cash: If at the time of delivery, the online buyer does not have coins or bills, the carrier will not be able to deliver the product.

• Deliver the complete online order, which will include the cost of the purchased good (VAT included), the cost of delivery to the carrier's home, and the cost of the cash on delivery payment method.

5.  Product Returns and Exchanges

If after delivery, after carefully reviewing the merchandise, the customer notices any anomaly not attributable to the carrier, they must contact THE PROVIDER within 15 (fifteen) calendar days and explain the incident with all the details so that THE PROVIDER can resolve it as quickly as possible.

After this period of time, it will be understood that the customer accepts it and will not give rise to any claim.
